ENUGU: ENSIEC CANNOT CONDUCT LG ELECTIONS DURING THE PENDENCY OF A MATTER BEFORE THE COURT OF APPEAL

The Enugu State Independent Electoral Commission ENSIEC and the Enugu State Government led by the Peoples Democratic Party (PDP) have concluded plans to conduct Local Government elections in the coming month of February. Adding salts to their injuries, the duo having known about a pending case before the Court of Appeal decided to embark in such an illegal and suicidal mission by disregarding the Appeal Court of the Federal Republic of Nigeria.

The All Progressives Congress (APC) had challenged the constitutionality of various Caretaker Committees constituted by the PDP led government in the Enugu State High Court. The Court delivered Judgement and declared the Caretaker Committees and Transition Committees set up by Enugu State PDP led Government as illegal but refused to order the swearing in of APC Candidates.

Currently, APC lodged appeal in Appeal No. CA/E/403/2019. There is also an application for interlocutory injunction before the court of Appeal in Appeared No. CA/E/403/2019: APC & ORS. V. ENSIEC & ORS. to restrain ENSIEC from conducting any Local Government elections pending the hearing and determination of the said Appeal No. CA/E/403/2019.

ENSIEC conducting LG elections in Enugu State will amount to the contempt of the Court of Appeal. ENSIEC and the PDP led Enugu State Government should be ready to face the grave consequences if they do so.

Not until the subject matter before the Court of Appeal is determined, any election conducted by the ENSIEC and its partner, the PDP led Government, is a gross misconduct, illegal, null and void.

The APC has in a statement released yesterday, disassociated itself from the elections. According to the State Chairman, Hon. Deacon Okey Ogbodo, “APC will prosecute the Appeal No. CA/E/403/2019 to its logical conclusion and will not engage in any elections at the Local Government level, which subject matter is pending before the Court of Appeal, Enugu Division”.
